Can I install workplace CCTV?
Yes, with legitimate interest, transparency, no hidden recording, and strict minimum. The AP enforces here and steps in if the balance tilts against employees.
Try this first
- 1Document the purpose. Theft prevention, safety around cash or stock, first-aid response. "Monitoring employees" in general is a red line.
- 2Run a DPIA. Workplace CCTV is on the AP DPIA list.
- 3Inform employees. Written in the handbook or policy, plus visible signs at entrances. Hidden recording is only allowed under strict conditions, short term, for a concrete incident.
- 4Cap retention. AP guidance defaults to a maximum of 4 weeks, longer only with a concrete incident.
- 5Check works council (OR). CCTV often needs OR consent under the WOR.

Want facial recognition or AI behavioural analysis on the footage? High-risk under GDPR and the EU AI Act. Do not set up yourself.

- Does NIS2 apply to my company? Two questions decide it: are you in a listed sector, and do you meet the threshold from Recommendation 2003/361/EC (more than 50 FTE and more than EUR 10M turnover or balance sheet). Below that you are only indirectly in scope, via your customers. The threshold determines whether you are an important or essential entity depending on sector.
- What changes with the Dutch Cyber Security Act?The Cyberbeveiligingswet is the Dutch implementation of NIS2. Track NCSC for the exact effective date and the lower regulations.
- Am I personally liable as a director under NIS2?Yes. The board is accountable for approving and overseeing the cyber measures. Severe negligence can become personal.
